Applicability

  3. If you order on our website, we ask you to accept the service conditions to make sure you have been able to take notice of the service conditions before completing your order.
  4. To all agreements between Ztijl and the customer, exclusively Dutch law applies.

ORDERS AND RESERVATIONS

The offer of Ztijl

  1. Ztijl has a web shop with an extensive and accurate description of the products offered. The description is suitably detailed to enable the customer to assess the products adequately. If Ztijl makes use of pictures, they are truthful images of the products provided. Obvious errors or mistakes in the offer are not binding for Ztijl.
  2. Ztijl only sells original vintage articles. Because of their age, the articles can have usage and wear. To describe the condition of the products, Ztijl uses the following categories: excellent, very good, good, fair and poor.
  3. Ztijl checks all offered products on reliability and safety. De electric wiring of the offered lamps has been checked and replaced if necessary.
  4. Ztijl sells fittings without light bulbs, halogen lamps, or Led.
  5. Products can be supplied subject to availability.
  6. It is possible to visit our warehouse in Berkel en Rodenrijs and look at the offered products. You can e-mail or call us for an appointment. You can find our visiting hours under ‘contact’ on our website staging-ztijl.kinsta.cloud.

Orders and (Quote for) Shipping

  1. Orders and reservations can be placed in the webshop staging-ztijl.kinsta.cloud or by e-mail.
  2. A lot of orders in the web shop can be completed right away. If the rates for shipment are known, you will immediately see the height of the shipping costs online. If you accept these costs, you can proceed straight to checkout. See Payment Options for more information on how you can pay.
  3. If the shipping costs cannot be calculated straight away, the web shop will show you the option to choose for a custom quote by email. You will receive this custom quote later by e-mail. This quote is not binding and without obligation. The validity of this offer expires three days after the date of quotation.
  4. If you agree with the quotation, you can proceed to checkout. See Payment Options for more information on how you can pay.
  5. When purchasing in the web shop or by e-mail, the agreement with Ztijl is established when Ztijl sends a (order) confirmation to the email address provided by the customer.
  6. As long as Ztijl does not confirm the order, the customer may terminate the agreement without charge.

Reservations

  1. It is possible to reserve products. Reservations can be made through the website and by e-mail.
  2. Because of the unique nature of the products, Ztijl can hold them only for a period of 3 days, unless agreed otherwise.
  3. After that period, Ztijl reserves the right to include the reservation in her offer again.

Prices & Taxes / VAT

Price Structure

  1. All prices in de webshop are in euro’s, including VAT and transaction costs, but excluding cash on delivery charges (if applicable) and excluding shipping costs as well.
  2. The height of the shipping costs depends on the delivery address and the size / weight of the order. See Orders and (Quote for) Shipping for more information on shipping costs.
  3. Obvious mistakes or errors in prices of shipping costs are not binding for Ztijl.

Taxes and VAT

  1. Ztijl applies by default the dutch margin scheme. This tax regulation applies to used products. VAT tax will be paid on the margin between buying and selling. Marginprices are VAT included, but there is no VAT amount mentioned on the quote and invoice. The margin scheme is indicated on the invoice as “VAT included according to the margin scheme (VAT included, but no VAT mentioned)”.
  2. The margin scheme applies primarily to individuals within the EU, but also for companies within the EU without the right to VAT refund. The total amount to be paid is lower because Ztijl is allowed to charge and pay less VAT.
  3. For companies in the Netherlands, we can also create normal VAT quotations and invoices. This can be requested by simply choosing the option ‘create a normal VAT quote’ in the order form. The total amount (VAT included) will be higher, because we have to charge and pay more VAT than under the margin scheme. However the amount without VAT is lower. Therefore this option is interesting for companies with the right to deduct taxes.
  4. For companies outside the Netherlands, but within the EU we can create quotations and invoices for intra-Community supplies. This can be requested by choosing the option ‘request a quote for an Intra Community supply’ in the order form. You will receive a offering by e-mail later on. Without a valid VAT number, the quote is not binding for Ztijl (you may leave your VAT number in the ‘order notes’). We check the validity of the VAT number. An intra-Community supply is only possible in combination with shipment. If you choose to pick up the order in Berkel en Rodenrijs, you will receive a quote and / or invoice in accordance with the margin scheme.
  5.  Companies and individuals outside the EU can currently only choose to apply for an offer in the shop. You will receive a mail with a quote at 0% VAT. This offer also includes shipping. Unless stated otherwise, all costs relating to the import of goods if any – such as clearance fee, customs duty and VAT – are on behalf of the client.

PAYMENT AND DELIVERY

Payment Options

Payment options are integrated in the web shop. Depending on the delivery address, Ztijl uses the following payment options:
1. Advance payment by iDEAL (in the Netherlands only).
2. Advance payment by credit card through PayPal.
3. Prepay by bank transfer (see ‘contact’ on the website for bank details).
4. Pay cash on delivery (only inside the Netherlands, additional costs)
5. Payment by debit card or in cash on pickup (by appointment) in Berkel en Rodenrijs, the Netherlands.

Payment Period

  1. Payment must be made within 3 days after ordering in the web shop or reception of the quote through e-mail.
  2. If we have not received your payment within this period, Ztijl reserves the right to refrain the order and ad the product(s) to her offer again. Before Ztijl executes this right, the customer will be informed by e-mail first.

Delivery

  1. Once we receive your payment, we will inform you about the details of the transport: the name of the courier, a track and trace number and the expected delivery date.
  2. Shipment of your order will take place within 5 working days after receiving your payment, unless a longer delivery has been agreed mutually.
  3. If you decide to pay cash on delivery (only possible in the Netherlands), your order is send within 5 working days after sending the order confirmation.
  4. The place of delivery is at the address given by the customer to Ztijl.
  5. Unless explicitly agreed otherwise, the risk of loss of and/or damage to products during transportation shall remain with Ztijl until the time they are delivered.
  6. Although we carefully pack all products, damage during transport can never completely be ruled out. If your order unfortunately still sustains damage during shipping, you must report it to us by e-mail within 48 hours after receipt of the order. The notification must be provided with clear photos of the damage to the product or products and packaging.
  7. To reduce the risk of damage, you should ensure that someone is present for the receipt of the delivery.
  8. Visible damage to the packaging is to be reported to the delivery person at receipt of the order.
  9. If the delivery has been delayed, or if an order cannot be filled or can be filled only partially, the customer shall be informed about this as soon as possible, but always within the legal term of 30 days after ordering. In such cases, the customer is entitled to cancel the agreement free of charge.
  10. In the event of repudiation under the preceding paragraph, Ztijl shall return the payment made by the buyer as soon as possible but at least within 30 days after repudiation.

AFTER SALES

Returns

  1. For all purchases in the webshop that are made from within the EU, the customer has the option to repudiate the agreement without specifying any reasons for a period of at least 14 days. This period starts on the day the product is received by or on behalf of the customer. The shipping costs for returning will come to the customer’s account.
  2. All returns must be announced by e-mail or telephone. If necessary, we will provide the customer with additional shipping instructions.
  3. Returning is only possible if product and packaging are in the same condition in which Ztijl delivered it to the customer.
  4. Please provide the returned products with a note containing you name and address, the invoice and your bank account number.
  5. You can also return the products yourself in our warehouse in Berkel en Rodenrijs, the Netherlands.
  6. As soon as Ztijl has received the returned products, the purchase amount will be transferred to you as soon as possible, but at least within the legal term of 30 days.
  7. If Ztijl has paid the shipping costs for returning the products, this amount is deducted from the purchase price.
  8. Unless agreed otherwise, the right to repudiate the agreement for a period of 14 days expires if the customer chooses to pick up the product in our showroom or if the customer has seen the product in the showroom.
  9. The right to return a product does not apply to purchases from outside the EU except Norway, Liechtenstein and Iceland and to purchases made by companies, unless otherwise agreed.

Warranty

  1. Ztijl guarantees that the products comply with reasonable requirements of usability and/or reliability subject to the description of the product in the web shop,
  2. Ztijl sells electronic devices as collectors’ products, they are not suitable for everyday use. This will be explicitly mentioned in de description of the products in de webshop.
  3. The customer should check the quality and / or the quantity of the products received, corresponding to the describtion in the web shop and / or email regarding the agreement. Additional visible defects should be reported to Ztijl through e-mail within 5 days after receipt of the product.

Liability

  1. The customer purchasing vintage products is assumed familiar with the requirements and regulations that were placed on safety and use at the time and place the products were manufactured. These requirements and regulations may differ from current legislation and / or legislation in the customer’s country.
  2. The customer is always responsible for compliance and ensures safe and responsible use of products purchased at Ztijl.
  3. If Ztijl should be liable, then this liability is restricted to what has been regulated in this provision.
  4. Ztijl is not liable for damage, of whatever nature, caused by her using incorrect and/or incomplete data supplied by or on behalf of the customer.
  5. If Ztijl might be liable for any damages, liability of Ztijl is limited to twice the invoice value of the order, or to that part of the order which the liability relates.
  6. The liability of Ztijl is limited to the amount paid by her insurer, as appropriate.
  7. Ztijl is never liable for indirect damages, including consequential damages, lost profits, lost savings and damage due to business or other stagnation.
  8. Ztijl is never liable for damage caused by customers picking up products from shelving by themselves. They should at all times leave that to the seller.
  9. The limitations of liability contained in this article do not apply if the damage is due to intent or serious negligence of Ztijl.

Complaints Procedure

  1. For complaints, please fill in the contact form or send an e-mail. We will always take your complaint into consideration. Your complaint is our opportunity to improve Ztijl.
  2. Ztijl answers complaints within 5 working days from the date of receipt. For complaints with a longer processing time, we will inform you within a period of five working days when to expect a more detailed answer.

PURCHASE, TRADE-IN AND RENT

Sell and Trade in products

  1. Do you have interesting design items, please let us know. Products must be in good condition. You can contact us by email on info@ztijl.nl or whatsapp.
  2. In order to make an assessment of the value of your offer, please send us at least 3 photos of the object in addition to your asking price. Please also state the traces of use and any damage and / or defects. Unfortunately, we cannot process your request without this information.
  3. If the purchase value exceeds € 500 we will ask you to sign a purchase invoice. With the signing of this invoice you declare not to have deducted VAT as input tax.

Renting Products

  1. It is possible to rent products for a certain period. The price is 10% of the sale per week. We charge only in whole weeks, one week is the smallest unit.
  2. In advance you pay the purchase price as deposit and we will return the deposit minus the rental fee after you return the products. Any damage to the rented products will be billed to the renting party.
  3. The renting party must take care of the transportation. Ztijl is not responsible for any damage incurred during transportation.

PRIVACY POLICY

ABOUT OUR PRIVACY POLICY

Ztijl Design cares a lot about your privacy. We therefore only process data that we need for (improving) our services and we carefully handle the information we have collected about you and your use of our services. We never make your data available to third parties for commercial purposes.

This privacy policy applies to the use of our online store and the services provided by Ztijl Design. This also includes purchases that are made directly in our warehouse as far as applicable. The commencement date for the validity of these conditions is 25/05/2018, with the publication of a new version the validity of all previous versions expires. This Privacy Policy describes what information about you is collected by us, where this data is used for and with whom and under what conditions this data can possibly be shared with third parties. We also explain to you how we store your data and how we protect your data against misuse and what rights you have with regard to the personal data you provide us.

ABOUT THE DATA PROCESSING

Below you can read how we process your data, where we save it, what security techniques we use and for whom the data are transparent.

WEBSHOP SOFTWARE WOOCOMMERCE, WEBHOSTING AND E-MAIL SERVICES

Our webshop is developed with software from WordPress / WooCommerce. We have outsourced the maintenance and management of our webshop to Sowmedia. They ensure that our software stays up-to-date and monitor the safety of our web store.

We have also outsourced our web hosting and e-mail services to the Internet agency Sowmedia. Personal data that you make available to us for the benefit of our services will be shared with this party. Sowmedia has access to your data to provide us (technical) support, they will never use your data for any other purpose. Sowmedia is obliged to take appropriate security measures based on the agreement we have made with them. These security measures consist of the application of SSL encryption, access to the management systems with two-factor authentication and a complex password policy. Backups are regularly made to prevent data loss.

Sowmedia in turn uses a number of third parties to provide services such as hosting, e-mail processing and backup storage. Sowmedia has confidentiality statements with all its employees and third parties with regard to the personal information with which an employee or third party would be able to come into contact in the embodiment of the maintenance contract. They have no access to our mailbox and we treat all our e-mail traffic confidentially.

Of course, Ztijl Design has also taken the appropriate technical and organizational measures to prevent abuse, loss and corruption of your and our data as much as possible by means of a strong password policy.

NEWSLETTERS VIA MAILCHIMP

We send our monthly newsletters via e-mail with MailChimp. You can register by leaving your e-mail address on the registration form at the bottom of the home page of our website or by placing a tick at the bottom of the order / quote form in our webshop. As soon as you do that, your e-mail address will be shared with Mailchimp for sending the newsletter. MailChimp will never use your e-mail address for its own purposes, but it reserves the right to use your data for the further improvement of the service and to share information with third parties. MailChimp uses cookies and other internet technologies that make it clear whether e-mails are opened and read. At the bottom of every newsletter we send you, you will see the ‘unsubscribe’ link, with which you can easily unsubscribe. You will no longer receive our newsletter. Your personal data is stored securely by MailChimp. We have concluded a processor agreement with the American company Mailchimp.

PAYMENT PROCESSORS

We use the Mollie platform to handle a (large part of) the payments in our web shop. Mollie processes your name, address and residence details and your payment details such as your bank account. Mollie has taken appropriate technical and organizational measures to protect your personal data. Mollie reserves the right to use your data to further improve the service and to share (anonymised) data with third parties. All the above-mentioned safeguards with regard to the protection of your personal data also apply to the parts of Mollie’s services for which they engage third parties. Mollie does not store your data for longer than is permitted by the legal terms. We also use Paypal and direct bank transfers.

SHIPPING AND LOGISTICS

If you place an order with us, it is our job to have your order delivered to you. We use the services of various online shipping services and transport companies to carry out the deliveries. It is therefore necessary that we share your name, address and residence details with them. These companies only use your data for the purpose of executing the agreement. In case transport companies engage subcontractors, they also make your data available to these parties.

INVOICING AND ACCOUNTING

For our records of our administration and accounting, we use the online accounting program Bokbiz. We store your name, address and residence details, telephone number, e-mail address and details regarding your order. This data is used for the administration of sales invoices and purchase invoices (for purchases of more than 500 euros). Your personal data is sent and stored protected. Bokbiz has access to your data to provide us (technical) support, they will never use your data for any other purpose. Bokbiz has taken appropriate security measures. These security measures consist of the application of SSL encryption, access to the management systems with two-factor authentication and a complex password policy. EXTERNAL SALES CHANNELS

We sell (a part of) our products through external sales channels. If you place an order via such a platform, this external sales channel will share your order and personal details with us. We use this information to process your order. We treat your information confidentially and have taken appropriate technical and organizational measures to protect your data against loss and unauthorized use.

PURPOSE OF DATA PROCESSING

We only use your data for the benefit of our services. This means that the purpose of the processing is always directly related to the assignment you provide. We do not use your data for (targeted) marketing. Your data will not be shared with third parties, other than to fulfill transport, accounting and other administrative obligations. These third parties have all been kept confidential on the basis of the agreement between them and us or a legal obligation.

PARTICIPATION IN TAX AND CRIMINAL INVESTIGATION

In certain cases, Ztijl Design can be held on the basis of a legal obligation to share your data in connection with government tax or criminal investigations. In such a case, we are forced to share your data, but we will oppose this within the possibilities that the law offers us.

RETENTION PERIODS

We do not store your personal data any longer than necessary for our services. Every three months after the end of the quarterly administration we delete the collected personal data that we have received via orders, quotation requests, the contact form and the enquiry form on the website and via e-mail. Of course we only do so for completed requests. For example, we will only delete an online order in the web shop if the return period for the relevant order has expired.

On the basis of applicable administrative obligations, we must keep invoices and your (personal) data. We will therefore keep this information in our records for as long as the applicable term is in effect.

You can view, correct or delete your data at any time. Send an email to info@ztijl.nl and you will receive an answer as soon as possible.

COOKIE POLICY

Ztijl Design attaches great importance to your privacy and therefore we only use functional and analytical cookies. Cookies are small files that are stored on your device.

FUNCTIONAL COOKIES

Our website uses functional cookies. These cookies are necessary for the website to work properly. Without these functional cookies you can not use the shopping cart, you can not pay electronically, you can not log in and some preferences (such as your language settings) can not be saved.

GOOGLE ANALYTICS COOKIES

In order to further improve our services, we use Google Analytics cookies. To this end, we automatically collect data. This data (for example your IP address, web browser and operating system) is not personal data and is also made anonymous: the last octet of the IP address is masked, ‘data sharing’ is turned off and we do not use other Google services in combination with the Google Analytics cookies. We have signed a processor agreement with Google.

SOCIAL MEDIA

Our website does not contain cookies from social media such as Facebook and Twitter. We do use buttons, with which you can share products on social media or links, with which you can go directly to our social media pages. As soon as you log in to social media or share our products, these sites will change your privacy in accordance with your own privacy settings.

CHANGES TO THE PRIVACY POLICY

We reserve the right to change our privacy policy at any time. On this page you will always find the most recent version. If the new privacy policy affects the way in which we process personal data already collected, we will notify you by e-mail if you have registered for our newsletter.
